The federal government has long preferred American goods and services. However, that preference - codified in the Buy American Act (BAA) - has been substantially narrowed and supplemented by a variety of international trade agreements and domestic legislation, including the Trade Agreements Act (TAA) and the Berry Amendment. The interplay between these COO laws and their associated implementing regulations is often complex and can present traps even for experienced government contractors. This webinar will address the basics that every government contractor should know about COO rules. Specific issues will include:

  • When does the BAA apply?
  • BAA "domestic end product" test
  • When does the TAA apply instead of BAA?
  • TAA "substantial transformation" test

Bill Shook is co-author of Government Contract Law 2 ed. and has over 30 years of government contracts experience, including over 20 years as the Chair of the Government Contracts Group at Preston Gates (now K&L Gates).
